His plan is not to use congress to ban guns. He is going to use international treaties. He has already committed to this during his South American groveling. The Senate will ratify the treaty because there are not enough true conservatives to stop it.
The only thing that might stand in the way is one and one swing vote on the SCOTUS.

Your are right on target. While Pres.Obama stated in Mexico that he would not pursue the ‘assault weapons ban’, he did strongly state that he would support and adhere to international treaties. The treaty he referred to has it's basis in United Nations doctrine, to ban small arms worldwide. All Pres.Obama needs to do is have the Senate ratify the treaty, and it would have the full effect of law. Instant ‘assault weapons ban’!!!
