That sounds to be a fig leaf phrase. The pirates took a hostage and threatened to kill him. OK, hostage is in danger! All we had to do was wait till we had a clear shot at the pirates.
Looks like he comes out smelling like a rose on this one.

We don't have the facts nor do we know if that was the plan. It could be that the second escape attempt by Phillips was unplanned and that the ROE just kicked in.

WASHINGTON (AP) — A Somali pirate captured following a hostage standoff in the Indian Ocean was in military custody Sunday and could face life in a U.S. prison.
“He’s in military custody right now,” FBI spokesman John Miller said. “That will change as this becomes more of a criminal issue than a military issue.”
Both piracy and hostage-taking carry life sentences under U.S. law.
Both Miller and Justice Department spokesman Dean Boyd said no decisions have been made regarding charges against the lone surviving pirate.
“The Justice Department will be reviewing the evidence and other issues to determine whether to seek prosecution in the United States,” Boyd said.....

It appears that most, if not all, of the remaining hostages are not Americans. If the US took rescue actions wthout consulting with their national governments, and harm comes to them, we will get no thanks. If we do consult with them there will be leaks. It is not a simple matter.

There are a lot of RINO’s who are so worried about “how Republicans look and appear”. Funny how those are the exact Democrat Operative Concern Troll Talking Points on any given MSM talking head show or internet board.

Could not agree more. We can see through the adoring media reports regarding Zero’s role. Even if he simply ordered the Navy to use best judgment, conservative opinion should support that.

If he was under 18 at the time and can prove his maturity level is that not of an adult, the most he can get is a few years. This terrorist will be under US law and protection of our Constitution.
