Senate Confirms Justice Department Nominees [McCain/Graham, RINOs vote yea]

The Senate confirmed David Ogden as deputy attorney general this afternoon, by a vote of 65-28, after an often testy debate between Republican and Democratic senators that dipped in and out of discussions of pornography.
Mr. Ogden, who had served in the Clinton administrations Justice Department, also represented Playboy magazine and librarians opposed to congressional mandated software that filtered content from the Internet when he was in private practice.
His First Amendment work ignited some opposition, prompting what Senator Arlen Specter, the ranking Republican on the Judiciary Committee, termed an unprecedented number of phone calls and contacts from citizens against Mr. Ogden. (Mr. Specter approved the confirmation, saying that a lawyers role as an advocate carried that responsibility, and that such representation should not imply that someone holds the same views as a client.)
Others, including Senator Charles Grassley, Republican of Iowa, denounced the choice of Mr. Ogden. They contended that his representation of such clients amounted to a predilection toward such views, despite Mr. Ogdens assertions during his Judiciary hearings that he found child pornography abhorrent.
Senator Patrick Leahy, chairman of the Judiciary Committee, has lamented for weeks the attacks on Mr. Ogden, and today he called them scurrilous. Mr. Ogden will run the day-to-day operations of the Justice Department under Attorney General Eric Holder Jr.
In all, one Democrat, Senator Bob Casey of Pennsylvania, voted against confirmation; 11 Republicans supported it. They are Senators Lamar Alexander of Tennessee, Christopher Bond of Missouri, Susan Collins of Maine, Judd Gregg of New Hampshire, Lindsey Graham of South Carolina, Jon Kyl of Arizona, John McCain of Arizona, Richard Lugar of Indiana, Olympia Snowe of Maine, Mr. Specter of Pennsylvania and George Voinovich of Ohio. (Six senators did not vote.)
