Senator: Eligibility is up to the voters Implies that constitutional demands can be bypassed

A U.S. senator has suggested that voters have made Barack Obama eligible to occupy the Oval Office, whether or not he meets the constitutional mandate of being a "natural born" citizen.

The comments from Sen. Mel Martinez came in an e-mail sent to a constituent shortly after the election, which just now was forwarded to WND.

The constituent had asked about Martinez's perspective on the issue on which WND and others have reported: claims made by dozens of lawsuits around the country that Obama might not meet the constitutional qualification for various reasons.

"Presidential candidates are vetted by voters at least twice – first in the primary elections and again in the general election. President-Elect Obama won the Democratic Party's nomination after one of the most fiercely contested presidential primaries in American history," Martinez responded.

"And, he has now been duly elected by the majority of voters in the United States. Throughout both the primary and general election, concerns about Mr. Obama's birthplace were raised. The voters have made clear their view that Mr. Obama meets the qualifications to hold the office of president," he wrote.

Multiple WND calls to Martinez's offices in Washington and Florida today asking for comment did not generate a response from the senator.

But he admitted the "federal government has the responsibility to make certain that the Constitution of the United States is not compromised. We must fight to uphold our Constitution through our courts and political processes."

He cited the constitutional provision requiring a president be "natural born."

But Martinez noted the Constitution does not provide for an enforcement mechanism, and he cited a federal court opinion that a taxpayer and voter in Pennsylvania didn't have standing to force Obama to provide documentation of his eligibility.

Gee, Mel, it's kind of hard for us voters to vet somebody when you don't have, and can't get, access to the documentation that is necessary to do so.

Senator, with all due respect, f*** you. The Constitution is THE LAW OF THE LAND and nobody is above it, including their personal feelings what they WISH would be true.

I think the more I see things going, I think we’re going to really need a large purge in this country. The intestines are pretty badly clogged and need a good flushing out. More and more these aristocrats are acting like kings and ignoring the laws they claimed they would uphold.

Remember the last king over us? We kicked his troops out of this country. At great cost, and not everyone here had skin in the game, but we did it.

OK you Freeper voters...I want Mel’s Senate seat. I’m not age eligible nor a Florida resident but that doesn’t matter. Hold a special election here in Freeperland and elect me. Once I’m elected I’ll take those results to DC and take over the office. BTW...I AM A CONSERVATVE.

So constitutional demands can bypassed. Well how about the one for term length. Let’s reduce Barry’s to 6 months and schedule a revote on the second Tuesday in May and let the winner start July 20th. Revote the House and Senate then too. I guarantee you the message and policies coming out of DC would change overnight in an effort to present a better economy to the electorate. Rush would decline to run. They guys that ran for GOP last time wouldn’t go over well this time and the next batch would either be too busy or isn’t ready yet. So go for the promising long shot. Run Jonathan Krohn. He already makes more sense than the Beltway GOP crowd and a LOT more than Obama. He can keep listening to Rush for advice if he gets in a pinch. Sure he’s only 14, but at least he is natural born. That’s close enough for Obama’s living constitution and with him heading ticket the youth vote can throw out the older doofus.

Martinez is an embarrassment to the GOP, the state of FL, and the US Senate. If he doesn't know any more about the role of a constitution in the Constitutional Republic form of government he should not be representing any state in the Senate, much less the 3rd largest state in the union. Apparently he doesn't know, or doesn't care, that you can't just ignore or wish away a Constitutional requirement for public office just because enforcing it would probably cause violent riots in all or almost all of the cities in the US.

If the people want the qualifications for the office of President changed, the amendment to the Constitution necessary to make that change would require the approval of 2/3 of Congress and 3/4 of the 50 state legislatures. I don't think 38 state legislatures would ratify such an amendment since Obama didn't carry that many states in the general election or the Electoral College. But even if an amendment were to be passed and ratified now, it would not apply to Obama because he was elected while the previous qualification was in effect, and if he was not born on US soil he did not qualify for the Presidency at the time the Electoral College met and made his election official.

He could stop the speculation and lawsuits by simply producing a valid HI birth certificate, but he hasn't done that in spite of the ongoing controversy. IMHO he is obviously stonewalling in hopes that the matter will eventually fade away. Which leads me to believe that he is not qualified and should be removed from office by the SCOTUS if he can't, or won't, produce the original documentation necessary to prove beyond reasonable doubt that he was born on US soil.
