It was adopted as an FCC rule in 1949, see FCC, Report on Editorializing by Broadcast Licensees, 1949. The legislation referenced in the polemical article you linked to was the creation of the Communications Act which created the FCC. The article is misleading at best, more fairly its an outright lie. The creation of the FCC no more created the Fairness Doctrine than the requirements of the Republican enacted Federal Radio Commission’s 1928 requirement that licensees show...“due regard for the opinions of others.” did or the later prohibition of editorializing of any kind on the radio (which didn’t last long).

Because I won’t drink the green koolaide doled out to radio listeners by the genius who gave us “Operation Chaos”? Given what he “accomplished” in the last election, an astonishing success right up there with his marital triumphs, he should be off the air with or without the Fairness Doctrine.

If Eisenhower, Nixon, Ford and Reagan could govern and the nation survive with Free Speech intact under the Fairness Doctrine, it can now. This whole thing phony issue is ginned up by people who make their livings spouting off on the radio. It has nothing to do with Free Speech, as the Supreme Court has decided. It is causing the right to become fixated on an issue which has virtually nothing to do with the well being of any of us on behalf of the likes of Limbaugh and his imitators.

You are correct, the Fairness Doctrine was not adopted until 1949.

The FCC’s power was upheld here:

But an argument can be made the whole thing did indeed grow legal roots in the original Radio Act of 1927.

“That this Act is intended to regulate all forms of interstate and foreign radio transmissions and communications within the United States, its Territories and possessions; to maintain the control of the United States over all the channels of interstate and foreign radio transmission...”

But then the entire premise of the FCC and its antecedent laws and regulations was the limited broadcast spectrum available and the need to prevent interference. Here is some earlier law pertinent.

As the web grows and eventually overtakes and obsoletes radio and television, the need for the FCC and its myriad regulations will recede. Communications itself will be “open source” and will be resistant to control in any form.

If they (the Marxists) shut down talk radio, the game will be...officially....ON.

I don’t know which side will ultlmately win...but I DO know that we will be too involved or otherwise ‘engaged’ to help Isreal when the time comes. Which is, now that I think of it...probably EO’s (and Big O’s) plan....all along.
