It defies both.
n March, U.S. District Judge John Roll rejected a motion by Mr. Barnett to have the charges dropped, ruling there was sufficient evidence to allow the matter to be presented to a jury.
I can't find too much on him. Based on that quote alone, he sounds like a big weenie.
