Explain this in more detail, including the part about the defendant staying in custody after the charges are dismissed...I truly am confused.

Honestly, I don’t know the details about him staying in custody after these charges are dismissed. My limited understanding of it is that a lot of the people at Gitmo are there without any current charges filed. The specific charges against this guy were filed only last year, I think, but he’s been there longer than that. So the fact that these charges were dropped don’t lead to release. They’re all still being held there under the Bush administration rules, whether there are current legal charges or trials or not.

I think this just puts him in the same situation as all the others there. They remain in custody. There’s a 120 day review of procedures. Then decisions will be made about how to change procedures for trials (military, civilian) or sending some to other countries.

That’s my understanding but don’t hold me to it.

I think he would still have to be held as an enemy combatant...which means Obama agrees with the eeeeevil Bush / Cheney Administration's definition of the Gitmo terrorists. Irony rules.
