The president's power to pardon is almost absolute. There is no need to run it by the Justice Dept or anyone else.
Like it or not, I gave you the real reason: Bush's petulance.
While a President can pardon someone currently serving a sentence. It is never done. Those currently serving a sentence can have their sentence commuted, but only those who have finished all aspects of their sentence will get a pardon.
Pardons are occasionally granted before prior to any legal action as with Ford’s pardon of Richard Nixon.
The next conservative US President can pardon the agents. (If we ever have a conservative president.)
I hope their first TV appearance is with Glenn Beck, he was all over this one from very early on if I remember correctly.
