NACOGDOCHES, TX (KTRE) - According to the Texas Department of Transportation, 98% of all DWI arrests stem from the person driving a car, truck, or motocycle.
But that last 2% can leave the door wide open, as the Nacogdoches Police Department found out late Monday night.
"It is one of those things that you kind of stop and chuckle," said NPD Information Officer Segeant Greg Sowell.
But it was no laughing matter, Nacogdoches police had to hit the law books for an unusual incident.
Late Monday night, Gerald Herbert Jr., was arrested for driving while intoxicated.
But he was not driving a car or truck, it was a tractor.
"Our officers located the tractor, and when they turned around to stop the tractor, he pulled off the road," said Sowell.
Herbert was arrested and booked for DWI, the tractor was then impounded.
Nacogdoches police say, tractor or not, this case is no different.
"The public needs to know that it can happen as well, it is a motor vehicle as defined under the penal code, and you can get a DWI for a tractor or any type of equipment like that," said Sowell.
Tractor or not, police say, the same rules still apply.
"If they are going to drink, then they do not need to drive a car," says DPS Trooper Greg Sanches, "these contribute to alot of accidents and people getting hurt and getting killed on the roadway."
"We would not treat this any different than we would any other DWI," said Sowell.
While this case is as serious as any other, don't expect DWI's on tractors, to be a common theme.
" know that in the city of nacogdoches, it is a rare occurance, mainly because we do not have a lot of tractor traffic," chuckled Sowell.
While some may find humor in this story, the facts remain the same, over 1,600 drivers are killed every year in Texas from alcohol realated incidents.

Tractor must have been newer than sheriff's tractor,,, i.e. sheriff needs new tractor,,,sheriff will get "impounded" tractor..
I had a friend who accumulated 7 DWI. One was issued after police fished him out of the bushes when he fell off his bicycle.
Well the trail rides into Houston to kick off the Houston Livestock and Rodeo Show will begin soon and a good part of that 2% could be the horse riders and wagon drivers on these moving parites. The police block off intersections and such for safety but I have seen a rider fall off and need ambulance transport.
I saw a guy driving John Deere lawnmower down the street in Benton, WI, in the pouring rain, drinking a Coors Lite.

That's right boys and girls, Michigan will give you a ticket for drinking beer while you mow your lawn.
You see, they know that the county/state has the “right of way” 30 feet each side of the center-line of the road.
That means that the very front 15 feet or so of your lawn they figure they have the right to arrest you, even though you never were on the road.
Michigan makes a ton of money off their nanny state commie rules.

I know someone who got a DUI on a bicycle, and another who was busted for DUI on a mule. I figured the mule knew the way home and would not have been a hazard to navigation simply out of self-preservation, so he shouldn't have been nabbed for that one, but the court found him guilty.
As they said on the news last night, it was a TWI.

My uncle was arrested for 'driving drunk' while sitting in his rockin' chair on grandma's front porch. Yes, he was drunk but hadn't been anywhere in 2 days but there. He had loaned his car to his 14 year old brother who had been speeding and beat the law to the house, throwed the keys into my uncle's lap as he ran up the hollar.....the older uncle said nuttin' the patrolman and went to jail and took the hit.
That same uncle 15 years later went to jail driving his riding lawnmower drunk....he was on his way back from a 10 mi trip one way trip (20 mi total) to go the the grass for an 82 yr old widow, no kin around & house bound off a secluded dirt gravel road, who's lawn had grown over terribly....he worked there 6 hrs that day before leaving stopping by a buddy's house to have a snort about 1/3 the way home. The very same cop pulled over to hassle him and then take him jail, again.
Honest to my name, I swear, both are confirmed stories first told to me by a relative and friend who went to get him out of jail.
My uncle was scrapping monies together to get some new tires for his pickup, but wouldn't dive it to take the mower....he didn't have much to do that Wednesday and made a sober decision to help some one......the widow tried to pay him, but, he never would take anything from her other than a piece of pie,or, a bowl of pintos and a biscuit. He took her fresh vegetables for over 25 yrs every summer from his garden......there's more to the end of that story about greedy, never come to visit out of state children and lawyers that challenged the will and won has she left what she had to my uncle.
Of course the court did. In the words of Rush the Wise, "Follow the money".
I may have overlooked it but what was the PC for stopping the tractor? I’m assuming that they had a report since the article said “...officers located the tractor...”.
I’m sure, knowing Texas (I’m Texan), the officers asked, “Do you have any weapons or something I should know about?”, gee I hope he had the required slow moving vehicle symbol on the back, you can really stack cases and look good!
