A gay Dallas man who married his husband in 2006 when they lived in Massachusetts has filed what is believed to be Texas first same-sex divorce petition.

The petition, filed Wednesday, Jan. 21 in Dallas Countys 302nd District Court, sets up a legal fight over whether Texas courts can grant divorces to same-sex couples whove married in other states.
Texas, which has a constitutional amendment defining marriage as the union between a man and a woman, doesnt recognize same-sex mariages from other states. In 2003, the state Attorney Generals Office ruled that a same-sex couple from Beaumont couldnt use a Texas court to dissolve the civil union they obtained in Vermont.
This should be very interesting....

The court should state that since Texas does not recognize their marriage, they need to go back to Massachusettes and file for divorce there.

If judges believed in following the law, this would be a no-brainer. Two people who are not married cannot get divorced. If they've been pretending to be married, that's not the court's problem; they can stop pretending and go their own way. Case closed.

In fairness to Mitt,it was the Mass. Supreme Court who unleashed this. And of course the MA state Legislature has blocked letting this go to the voters, twice. Romney really had nothing to do with it
