I don’t see why the casino is liable. Did they know the funds were stolen? Who’s negligence caused this? I’d say it was Weight Watcher’s fault.

“But the lawsuit targets Rainbow because Belk allegedly delivered fraudulent checks she wrote to herself from Weight Watchers to a Rainbow employee who authorized the casino to cash the checks for Belk, said Weight Watchers’ attorney Wilson Carroll.
They have a bit of a case, but not much of one. They could try to show the employee knew what was going on.

It looks like the casino is not actually being sued because she gambled there, but because they cashed fraudulent checks for her.

This will be interesting...how could a woman be cashing so many checks from a business account at a casino? I think at the very least, the casino needed to ask some serious questions.

Lettuce be quite clear: this woman made quite the culinary gaffe. "Taking a mint" is supposed to refer to availing oneself of a garnish sprig or an after-dinner candy--it's considered bad form to take the whole enchilada. She got greedy and now her salad days are over, Rover.
Speaking of culinary gaffes, don't forget the recent case of the Mr. Jefferson who kept cold cash from a bribe in his icebox...

Belk, whose annual salary was about $40,000 a year, wrote 554 checks to herself from Weight Watchers' accounts.
She pleaded guilty in October to stealing the money over six years, beginning in 2000.Okay; she's the bookkeeper, but where's the Comptroller? And where's the auditor?
Might as well sue the bank for honoring the checks, too.
Oh, and where is the "second signature" policy and a policy to prevent individuals from writing checks to themselves? Those checks averaged around $1,800 each. Not exactly petty cash funds, though still smallish; but, at nearly TWO such checks per week....
The business has a LOT of explaining to do, to convince a jury that their hands are clean, and it's just the 'dirty" casino's fault, and none of their won.
Wonder how much she "owes" IRS in taxes, penalties, and interest on the illgotten, most likely unreported, gains?

In spite of my First Wife telling me that W/W is my salvation I have not contributed one dime for her to misappropriate from her employer.
What you say about controls at all levels was nonexistent is correct. I severed on the board of a small national trade association in the late 80s and one of the management staff was redirecting incoming checks to bogus accounts controlled by her and went so far as to print bogus bank statements and balance sheets with her quick print shop she owned. Three of the directors called for audits but the majority would have no part of it because they didn't want to spend the money. It didn't come to light until her partner tried to buy her out and his auditors found it. I got a call from ATT telling me there was going to be a conference call the next day. 15 members sat in stunned silence as the attorney and cpa outlined the fraud. We were reimbursed for part of it and she spent a couple of months in a Texas jail...
