DOJ Considering Commutation for Ramos, Compean

The U.S. Department of Justice has been opened a file on imprisoned U.S. Border Patrol agents Ignacio Ramos and Jose Compean and a commutation of their sentences is under review, the office of agency pardon attorney Ronald L. Rodgers confirmed to WND.

Rodgers spoke directly about the case by telephone with Stephen J. Eichler, J.D., executive director of Jim Gilchrist's Minuteman Project Inc..

Eichler initially called the DOJ pardon attorney's office to discuss the prospect of a presidential pardon for Ramos and Compean. The men remain confined to solitary confinement in federal prison serving 11- and 12- years respectively for a 2005 incident in which they fired on a drug smuggler as he fled back into Mexico after bringing 750 pounds of marijuana into the U.S. near Fabens, Texas.

They need the commutation and then pursue their avenues of legal remedies. A pardon would not help them at all. They would still go through life with that record and ever getting a permit to carry a concealed weapon, work at casino, work with kids, etc. would be problem.

A pardon would also interfere with them working to have the convictions overturned.

IMHO

He needs to get busy if he is going to do it. I do expect he would wait to the last minute if he was going to pardon or commute their sentence.

At this point I think most of us would be thrilled to get them released. I suspect there are plenty of honest businessmen out there who would happily give them jobs.

Laura Ingraham was ALL over this today. She interviewed the wives by phone. They're a wreck. They get one visit a month as well as one monthly phone call for 15 minutes. One of the prisoners, either Ramos or Compean, listens to Laura every day with a battery operated radio. Unbelievable.

Laura insisted EVERYONE email or call the White House. Dubya should do the right thing and put his signature on that piece of paper.

I assume that is for their own protection. However, is that not grounds for a lawsuit?

Is it fair to punish them further because the prison cannot protect them?

Where is the ACLU on this one, or Amnesty Int'l?

That works for a while, but pretty soon everyone forgets about you and you're just another ex-felon. State and Federal laws have been tightened to the point over that last decade or so that those who would hire you have little discretion.

I agree, getting them out is the big thing right now. But that's only the start of the rest of their lives. It needs be done in such a way as to assure them of the best quality of life possible.

Once you are pardoned it's supposed to be as if the crime never occurred. You can't appeal a conviction that never happened. The assumption is that a pardon would make further appeals unnecessary. It worked that way for a couple of hundred years. The last 20 or 30 years though the states have been passing laws that in effect trump the pardon.

So few people are caught up in the Catch-22 that it doesn't get lots of play. But it's a major pain the patootie for a lot of people.

Imagine being convicted of a felony 50 years ago, then being granted a full and complete pardon 10 years later, only to learn that laws in your state still prevent you from carrying a weapon, working with children, etc.
