Undoubtedly the civilian discovery rules will rule out any chance the military will reveal enough of its techniques to enable prosecution. The cases will be dismissed for lack of cooperation by the military. It’s a get-out-of-jail-free card for the detainees and possibly the lottery of punitive damages against the military (taxpayers) for their period of incarceration and mental anguish.
And any terrorist who does by some quirk of fate get convicted will just be given the FALN treatment (pardoned when it is politically advantageous).
