I wonder what the man was expected to do? Shake the attacker's hand? The attacker deserved a bullet after what he did.

Agreed. But we are supposedly spreading the Rule of Law.

I see nothing wrong with shooting the attacker .

Then you wouldn't mind vigilante justice in the States? If not, then why do we institute it at the barrel of a gun in someone else's country?

I hope he is found innocent.

Perhaps temporary insanity will be understood.

It's called saving the court system time and money by acting in a justifiable manner.

I’m confused. Who is charging him?

Don Ayala of New Orleans is charged with second-degree murder in U.S. District Court in Alexandria.

That clears up the question I had. I wouldn't agree but I could understand if Mr. Ayala were charged by an Afghani authority. The fact that charges were brought by a U.S. authority is disgusting.

Source please, so we can understand this mess better....

happinesswithoutpeace listed one: http://www.businessweek.com/ap/financialnews/D95JPF980.htm

Ayala, 46, who worked for BAE subcontractor Strategic Analysis, Inc., helped subdue and arrest Salam, who was restrained and placed in plastic handcuffs. About 10 minutes later, after a soldier reported the extent of Loyd's injuries, Ayala pointed a pistol at Salam's head and fatally shot, according to the affidavit. His trial date has not been set.
Let's hope that this isn't what happened and that the trial clears him.

The contractor, Don Ayala of New Orleans, Louisiana, is accused of shooting the Afghan civilian in the head after having helped restrain him. He is charged with second degree murder in U.S. District Court in Alexandria, Virginia.

He should have shot him first, then restrained him. Note to CNN: since when is a Taleban terrorist who sets fire to an American civilian contractor himself a civilian?

According to an affidavit, an Afghan civilian named Abdul Salam ignited a pitcher of fuel and threw it on Loyd.

So Ayala was just a BAE subcontractor, walking around armed, and after 10 minutes decided to off a taliban held in military custody all by himself....

OK. I read the link provided at post 14. It makes more sense, but my sympathies are with Mr. Ayala. Temporary insanity work for anyone?

If I was in a muslim country & my coworker was set on fire & I had a gun I certainly would shoot. Why wait until I may be next? I think it is normal when you are in a dangerous place & you see your coworker attacked & you have a gun , then you would shoot. After all what justice is there in muslim countries when a woman is involved? Not very much that I can see.... And it is disgusting this man is being charged in in our country IMHO.

It was but it provides an opportunity for others to come in and bash people who posted without the full story. I still wonder why he wasn’t charged by an Afghani authority instead of a U.S. authority. I suppose that’s a matter of some treaty but if we’re supposed to be instituting a rule of law there shouldn’t their jurisdiction prevail?

I don’t think SOFA is applicable in Afghanistan, this is some bizarre NATO rule of law me thinks....

Yeah, temporary insanity, as well as the customs of the land. I'm pretty sure none of the Afghans was bothered by this.

If he's being tried in Alexandria there's a chance I might get called for the jury.

I know nosing!

Pure guess but State may have said “look we will handle it on our side”...for a variety of reasons. There have been US guys nailed over there for doing freelance CT stuff and they got put on trial over there and locked up.

I dunno. I tried reading through the comments at the site..but still not sure. It sounds like an episode of 24 though and as a woman, it sure was good to read some of the comments at the link. There are still real men left in America. The guy deserved a bullet in the head whether he was handcuffed or not. Sometimes justice demands swift action. One comment at the link was pretty interesting. He/she claimed the dude probably saved other lives at the scene by shooting the guy. Local customs and culture etc. Sounded about right to me.

One of Loyd's colleagues has been charged with second-degree murder in the shooting of the man who attacked Loyd.
^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^

The man should be awarded a metal. If this prosecutor is in the military he should given a dishonorable discharge.

This is unbelievable!!!
