CNN) -- Robbie Tolan sits in a Houston, Texas, hospital bed with a bullet from a police officer's gun lodged in his liver.

"There's no doubt in my mind that if these had been white kids this does not happen," said David Berg, Tolan's attorney.
It was 2 a.m. on December 31 when Tolan and his cousin, Anthony Cooper, were confronted in the driveway of their home by Bellaire, Texas, police officers. Police officials say the officers suspected the two young men were driving a stolen car.

As they walked up the driveway to their home, Anthony Cooper said an unidentified man emerged from the darkness with a flashlight and a gun pointed at them.
"We did not know it was a police officer," said Cooper. "He said, 'Stop. Stop.' And we were like, 'Why? Who are you?'"
The officers ordered both men to lie down on the ground. Tolan's parents heard the commotion and came outside. Police will only say an "altercation" took place. Tolan's family say it involved his mother.
"The cop pushed her against the wall," said Tolan's uncle, Mike Morris.

But Tolan's SUV wasn't stolen. Both men were unarmed and relatives say they were hardly a threat to the police officer. Anger over the shooting has been building over the last week.
"He was the victim of the worst case and worst kind of racial profiling," said community activist Quannel X.

"Anytime someone is injured we take it very seriously," said Byron Holloway, Assistant Chief of the Bellaire Police Department. "But any allegation of racial profiling, I don't think that's going to float."

The policeman is a white, 10-year veteran of the force whom police say has an excellent record.
Bellaire Police officials are no longer talking publicly about the case.

It appears that the young man was wrongly shot, but how it exactly happened is still open to interpretation. I would like to have information from all people present before I would start laying blame.
Attorney Berg's may be right. No way to prove it, pro or con. The flip side is that "the black community" needs to quit acting in a fashion that causes people, including other blacks, to consider them a threat.

Happens to white kids all the time.
I would say 100% right, black kid, expensive SUV, Cop had no business to be on property are to made a stop if the vehicle was not reported stolen!! Driving while black was the reason for this bust.
Aw, c'mon Mark. You've been here almost as long as I have. Surely you've learned in the past 10 years that there's no need to muddy things up by trying to learn the whole story.

Looks bad for the cops. If they had legitimate probable cause, it would be out by now. If it was phony or non existent, the brass have figured it out, and shut up.
If I wanted someone to respect and admire me as a ‘neighborhood organizer’, I don’t think I would keep the name ‘Quannel X’. Then again, my neighborhood doesn’t need organizing - or does it?
There are some on this forum, (not you) who howl about dirty officers needing to be punished before all the facts of the case come out. They remind me of liberals towing the party line. You know what their comments are going to be before they post. Seems as if they have an ax to grind. The investigation will proceed, and if there is evidence of wrongdoing, the appropriate punishment should be handed out.

According to a local Houston TV station, Bellaire apparently has a history of this sort of thing with other baseball players (who tend to be non-white and driving nice cars).
A few years back they stopped Jose Cruz Jr. and his wife and two kids riding in their Mercedes. Except for the getting shot part, they went thru the same sort of harassment. Ended up getting a personal apology from the police chief.
That being said, Quannell X is an opportunistic, Al Sharpton wannabe.
p.s. Bobby Tolan was one of the early members of the Cincinnati "Big Red Machine." I remember well his exaggerated, high handed batting stance.

Pay attention to the important part of what I wrote. It is time for blacks to join the rest of us. Racial profiling sucks. Take a look at the picture of "Quanell X" in this thread. Do you think his appearance, and that of the two brothers over his shoulders, is accidental?
I am not defending the cop, either. I personally don't trust cops beyond the ones I know personally. Most of them are good people, I know. I just can't tell the difference by looking.
Concur on racism/stupdidty. Concur on some cops are racists. So are some community organizers, teachers, lawyers, fire fighters, congressmen, senators, etc., etc.. I’m presuming your “More practice...” is in reference to cops. If so, then I Do Not conur. Most, and it appears this one as well, actually give a sh*t and do their job to the best of their ability. However, they’re hindered by the liberal laws that make the criminals appear as victims.
I’m a 22 year Navy vet, currently in Iraq, and more people haved said, “thank you” to me since 11SEP01 than did when I joined in 1986. When was the last time anyone said, “thank you” to a cop, firefighter, their kid’s teacher? They’re on a different “front line” every day. Give the guy a break unless you know more specifics than the rest of us.
It is a comparison of racist cops to stupid cops. Of the stupid ones, most are the generic kind of stupid rather than racist kind of stupid.
Roger, I wasn’t tracking your comparison/logic. I probably should have asked for an explanation first. But I still believe that the vast majority fit in to neither of those categories. But then that’s just my two cents...
