Not true. In NY state, the car does not have to be in motion, you don't have to be observed driving, you don't have to be in the driver's seat, the car does not have to be running, the keys do not need to be in the ignition, the keys do not even have to be in your pocket or even in the car... you can still get a DUI. Hell, you don't even need a car to get a DUI. Wheelchairs and bicycles will do.

Oh, and the limit is .05 not .08. Sure you need it to be .08 for a crime, but .05 gets you an infraction. The punishment is the same, but no probation/parole.
