From what I understand, DWI/license checks are constitutional. Remember - driving has been ruled a privilege and not a right. Not the same as “home as castle” doctrine.

How come you can't turn around at a check point? When NYC posted policemen to conduct random searches of bags prior to entering the subway system, you had the right to refuse a search and go on your way, just not onto the subway. Turn around before a police road block, and they go after you.

Remember - driving has been ruled a privilege and not a right. Over and over again.
See 716 P.2d 945 for an example of the "Driving is a Constimutushanal right" argument being dissected.

Remember - driving has been ruled a privilege and not a right.Well, if you believe that, it would be a lot more convincing if you at least attempted to justify that position with logic or morals. SCOTUS can rule anything they want and, while it does become the law of the land, their rulings don't actually have any impact on reality. For example, if SCOTUS ruled that my ass was made of cheddar cheese, I seriously doubt that mice would start following me down the street. Are you saying Kelo is right simply because it emerged from SCOTUS? Bean? Casey?

Sorry. Meant to include Dred Scott in my previous list of decisions that must be right cause SCOTUS made ‘em.
