Not legallly but it may affect someone’s ability to drive, especially those who don't drink often. I know I feel it after one glass of wine. Believe me, back in the day there were times I drove after consuming when I should not have. Thank God nothing ever happened. I am now older and wiser.:) I just wouldn't take that chance now.

In the eyes of the law it can. In Michigan (and most other states, I think) you can be convicted of drunk driving even with a BAC of 0.0.

If the arresting officer testifies he believed you were under the influence, the testimony is sufficient for the arrest and admissible at trial.
