I’m certain they don’t fry them for ATTEMPTED murder or malicious wounding. I don’t think Texas does,either.

Actually, this kind of scenario has been predicted for a long time as one probable outcome of police "SWAT-style" home invasions for drugs. I am totally opposed to this kind of "hot" type "warrant service" at "oh-dark-thirty". There have been WAY too many incidents of police invading wrong addresses, and civilians being killed or injured.
Serve the warrant the right way---in the daytime, by knocking on the door and waiting. If some perps manage to flush some drugs down the toilet---tough. The potential negative consequences outweigh the risk of not "making the arrest".

I hope they fry the nit wit over bearing police that performed the raid. He was found guilty by association. I would love to see if all the evidence made it to the store room or was a line or two missing.
