The point is that we are not arguing to overturn a Democratic victory. The victory would go to Senator Joe Biden if Obama were ineligible.
I do not understand how it automatically goes to Biden. IF Bama is not a qualified candidate then his votes do NOT count, and Biden did not as a candidate received one literal vote on his own. Now the electoral college might select Biden if Bama is not qualified.
