I wondered the same thing. Hospitals, I thought, will not give out information about their files. To file FOI for a medical record, one would have to be the person concerned.

I've also heard the law regarding the dispersal of medical records is pretty cut-n-dry. The tack the article seems to be taking is that medical records are only protected when they exist at the point of inquiry. If a hospital does not possess the medical records, the hospital is not prevented from saying so. If I called a Honolulu hospital inquiring about my own birth records, they would likely tell me, and anyone else inquiring, that they do not have my records -- or they would refuse to comment entirely. The article does not identify the method of inquiry or document the responses. As such, though an interesting article, it cannot (yet) be accepted as fact. I'd like to see this train of thought pursued further with a few of the details filled. in.
