Sarcasm not necessarily needed. The Federalists opposed the Bill of Rights - and only agreed to it as a way to gain passage of the Constitution itself - not because they opposed the rights articulated in the Bill, but because they asserted that the listing of rights in a Bill of Rights would inevitably be less that comprehensive - and that the existence of the Bill of Rights would be used to denigrate any right not explicitly listed. And that is precisely what McCain and Feingold, with the help of President Bush and a 5-4 majority including Sandra Day O'Connor, did.By styling themselves "the press" and their employees as "objective journalists," members of the Associated Press have conducted a century and a half long propaganda campaign to the effect that "freedom of the press" is a right exclusively of people who already own a press and are members of the Associated Press, and not a right of the people generally. In the process they have turned "the press" into an unconstitutional title of nobility.
So if we returned to status quo ante the First Amendment, we would theoretically have a better Constitution. Theoretically.
