Biden wouldn’t. He ran for Vice President, but he wouldn’t be eligible to “assume” the Presidency if Obigula is ineligible and there never elected by the electors. The electors could, of course, elect Biden, but would they? They could vote for John McCain and Sarah Palin.

Since under the scenario that he isn’t a citizen, Obigula has perpetrated a fraud on the country, and I’d start looking in the law books to see if there aren’t criminal charges against him. Since this is a unique scenario, I have no idea what we’d do.

But you watch - just like in 2000 with the Electoral College, the MSM and libs will be screaming that the law is outdated and antiquated and should be changed immediately. Unforunately, they can’t, and I don’t care how much they threaten to “riot” if Obigula doesn’t assume his throne, point your finger at the man who knew he wasn’t eligible and ran anyway - and he can’t use “ignorance” as an excuse - because he’s a Constitutional Law Professor, doncha know?

And they should ask for the VAULT copy of his birth certificate - no copies.

If Obama is declared ineligible, there will be chaos among the Democrats with Hillary back in play, Biden making a play, and lots of people angry that Obama’s been disqualified that might do anything, including vote for McCain to protest against the party.

The Electors could only elect Biden to be VP. He isn't a candidate for POTUS and cannot be chosen by the Electors to that office. The Constitution explicitly makes the two distinct and separate.

If 0 is disqualified before the EC votes then they can still vote for him, and some might have to because of faithless elector laws that some states have, and those votes would be challenged and thrown out. Some would be able to change their votes, but most likely nobody would receive a majority (270+) of the President votes. Then it goes to the house where each state gets one vote and a majority (26+) would be required with a quorum of 34 states also required. The House can only choose from the top 3 vote-getters. If that means Electoral votes then McCain is the only possible outcome. If that means popular votes then McCain, Nader or Barr (or Obama who is disqualified, McCain and Nader, depending on the interpretation of the 12th Amendment).

So, anyway, Biden can only ascend to the Presidency from VP.

Sad to say, with today’s technology, anything can be doctored. All he needs is one Kool-Aid drinker in that office, and he’s good to go.
