Any "swearing in" before January 20th would be just as unconstitutional as having a non-natural born citizen being sworn in. The Constitution says January 20th, at noon, specifically amendment XX,
Article. [XX.] [Proposed 1932; Ratified 1933] Section. 1. The terms of the President and Vice President shall end at noon on the 20th day of January, and the terms of Senators and Representatives at noon on the 3d day of January, of the years in which such terms would have ended if this article had not been ratified; and the terms of their successors shall then begin.
Anytime before then, he's a usurper. Even if, God Forbid, something were to happend to Bush and Cheney, he could not become President until noon on January 20th, 2009.
But if they weren't going to worry about that part of the Constitution, why wait on the formal Electoral college vote? Or they could have Congress pass "emergency legislation" to have the votes cast before the court case is to be heard, That date is set by law, not by the Constitution itself. We could have the electors get together over leftover turkey on the day after Thanksgiving, have Congress open, count and certify the votes and then have the coronation on Sunday December 7. (That day is already infamous, so no harm done).

Think of running a marathon. You have to sign up to be eligible to win the prize. If you run the race anyway, but never signed up, you are not eligible for the prize even though you ran. (Except in this case, he had not earned the RIGHT to even sign up for the race!)
