Who has standing to challenge the validity of a candidate to run for office, then? Does it have to be McCain? The current president's administration? The Democratic party?

Some of these suits throughout the country are being brought by the election officials from various states, who are charged with vetting the eligibility of the candidates that they are putting on the ballots.

This is not an inchoate right that is hard to define, but a direct and fundamental right of each and every voter in the country.

I know I would recommend that the US congress provide by statute that any candidate for federal office prove that he is qualified and place that proof in the public record.
