Would recommend that you look up the 12th and 20th Amendments. The answers are contained there.
Itgets complicated. With Obama DQ'd, logically it would go to McCain, but the Electoral College MIGHT not give him a majority.....then it goes to the House of Reps, where they would have to decide among the 3 candidates NOT disqualified who received the most electoral votes...by default that would go to McCain. The VP is decided seperately, so you would have a Mcain as Preez and Biden as VP. However, if it were to go past January 20, then sworn-in Obama would have to step down and Biden would assume the Presidency (Frightening thought!),
Not an expert here, but if the President-elect were disqualified before the electoral college does its voting, I believe the votes go to the candidate with the highest votes, which would be McCain. I think Veep is decided separately, so Biden would still be VP.
After they’ve done their voting, I think it would mean President Joe Biden... Oy vey...
I read that the House of Reps is responsible for confirming the eligibility of the winner. To me that means no matter what the investigation yields, the House will say he’s eligible and the electors will go along with that.
