They'd have to overrule all of their precedents to reach that result. And if the Justices were perceived as throwing out Prop. 8 to undo the will of the people, a recall drive would certainly be launched against them. We will see if they have the political balls to do it.

If the Supreme Court does nullify Proposition 8 on the grounds that it was a revision, that is going to be the end of the matter. No recall drive or non-retention vote will change the situation, because it will be politically impossible to appoint any replacement Justice who wouldn’t vote to uphold the decision.

Just as in Massachusetts, when it comes to gay marriage, people are happy to vote “no” or say they will do so on narrow questions, but when faced with a bigger choice: permitting gay marriage, or electing socially conservative Republicans, they’ll choose to permit gay marriage.
