Why would Biden be President if the votes for Obama are invalidated then McCain won right?
While this case should be pushed through immediately it wont be, liberal judges will say its immaterial.

I think you have answered your own question. The court system can delay this till after the inauguration, after which, I would expect that the succession clause of the constitution would apply, making Biden president.
