Tonight a new setback for supporters of the former border patrol agents at the center of an outrageous miscarriage of justice
DOBBS: Now developments in the case of former border patrol agents Jose Compean and Ignacio Ramos. A judge today upheld Compean's 12-year sentence for shooting a criminal illegal alien while he was fleeing. and was given immunity to testify against those two border patrol agents while still running drugs, of course. This comes even after some of his other convictions in this case were overturned by an appellate court. Casey Wian has the latest on this case of absolute outrageous justice from El Paso, Texas.

CASEY WIAN, CNN CORRESPONDENT (voice-over): Patty Compean's husband, Jose, a former border patrol agent, has spent nearly two years in prison, in protective custody for his part in the shooting and wounding of an illegal alien drug smuggler from Mexico in 2005. She was allowed to spend eight minutes with her noticeably thinner husband before a hearing to determine if his 12-year prison sentence would be modified now that an appeals court has overturned some of Compean's convictions.
PATTY COMPEAN, WIFE OF JOSE COMPEAN: He's doing very, very well considering that he's in solitary and it has to do a lot with the support and the love that he feels from the American people.
WIAN: Supporters of Compean and fellow imprisoned border patrol agent Ignacio Ramos say they are victims of an over zealous prosecution. They've collected more than 276,000 signatures asking President Bush for pardons. Many were hoping Judge Kathleen Cardone would reduce Compean's prison term by up to two years.

ED MASON, ATTORNEY FOR JOSE COMPEAN: We have an application for commutation pending at the department of justice. And there, it will go to the president's desk. But as long as we have pending litigation, we're not entitled to a commutation, which is different from a pardon.
WIAN: Different in that his conviction would stand, but his sentence would not. For now, Compean returns to prison.
CLAUDIA MARTINEZ, SISTER OF JOSE COMPEAN: All we can do is pray and hope, you know, that's all we have left at this point. Hopefully, things will turn around for us.
WIAN: After the hearing, Patty Compean hugged Monica Ramos, Ingacio's wife. He'll be in court Thursday but his attorney's will pursue an entirely different legal strategy including a reduction of his sentence and a transfer to a minimum security prison.

WIAN: The agents' families did receive good news recently. An anonymous donor has given $100,000 to their defense fund to help offset the incredible cost of having two fathers incarcerated.
DOBBS: All right, Casey, thank you very much. We'll continue to follow those developments. It's just an outrageous miscarriage of justice, and no amount of rationalization can change that. And apparently, this president doesn't have the sufficient character to try to reverse what is an outright wrong on the part of his administration. But anyway, we'll keep you up to date with further developments coming tomorrow from El Paso.

I was thinking they would get pardoned by Bush just as he was on his way out and that pissed me off enough. At this moment, I am really not sure that he will pardon them.
He is a lame duck and Obama is already acting like he is in charge, so what does Bush have to lose? Will people hate Bush more if he pardons them? Is he afraid his approval ratings will drop? Obviously none of those are the answer so one can only surmise that Bush is a jacka$$. Pardon them now so they can enjoy Thanksgiving and Christmas with their families. The security president..........pffffffffft...........the hell he is.

I said I would no longer support the lesser of two evils, starting this year but I relented and supported McCain.
This time I mean it; any candidate that even looks like he isn’t a fighter for Conservative principles I will not support.
I don’t care if Obama and Biden resign and they reanimate Stalin and he runs as the Rat nominee in 2012 (like we would be able to discern a great difference); I am not going to vote to keep Stalin out of office and vote for someone who defecates on Conservatives and then expects our support.
Bush I, Dole, Bush II, McCain? Not anymore. Looks like the pattern is Bush, an old guy, Bush, an old guy. Don’t even think about it, Jeb. lol

I’m not into the whole class warfare thing but the obvious unequal justice here is a little hard to deny.

I got tired of feeling betrayed, so I quit the Republican Party. It was mostly over Bush's lack of support for conservative principles like spending, size of government, and the southern border. Now I am a registered Independent. Whatever the party, the most conservative candidate will get my vote.

We have to figure out a way to get RNC to restructure primary elections so that...
1. Repubs ONLY . No Dems picking our candidate.
2. Primary voting should be done nationwide at the same time. It’s hard for true Conservatives to get the votes they need in the south when eveything startes and almost finishes in the North.

McCain was my LAST choice.
GW should pardon them before he leaves office. No if’s, and’s, or but’s. Just do it.
This could be one of the biggest disappointments in the Bush legacy. It is beyond me why the Bush Administration has not acted. I will NEVER vote for a Bush for anything; it does not endear the Republican party to me. I am beyond disgusted with the lack of mercy and compassion in this case.

Bush has done many things over the past 8 years which leaves a very bad taste in my mouth, but this is the epitomy of all his disgracefull "accomplishments," and I dare say, if he does NOT pardon these men, he will forever live with the stain of disgrace and rejection, among conservatives.

Ah, but it has acted by deliberately persecuting these two heroic men in the fist place, incarcerating them, and keeping them there in the face of intense opposition . Asking Bush for a pardon is like a Jew complaining to Hitler about about Himmler murdering Jews.
