Tom McClintock's lead in the 4th Congressional District race grew to 1,192 votes over Democrat Charlie Brown Tuesday afternoon, though neither side claimed victory.

With more than 40,000 ballots still to be counted in the district's largest three counties, McClintock had 159,738 votes to 158,646 for Brown, from Roseville. The percentage breakdown was 50.2 percent for McClintock to 49.8 percent for Brown.

El Dorado, Nevada and Placer counties all still had thousands of uncounted votes as of Monday evening, as did Butte and Sacramento counties, portions of which are in the 4th.

Because Tuesday was a state holiday, it was not clear whether county voter officers or the California Secretary of State's office would report updated counts of unprocessed ballots.

Campaigns for both men sent e-mails to supporters Tuesday asking for donations for legal costs related to ballot counting, and expressing confidence in an eventual victory.

McClintock told supporters that he needed yes votes from 48.95 percent of the remaining 52,000 uncounted ballots to clinch victory, and that all vote-by-mail ballots should be counted by the end of the week.

For Brown's campaign, manager Todd Stenhouse pointed out in the e-mail that many of the uncounted votes are from Nevada County, which Brown won by a sizable margin in Election Day returns.

I hope Tom holds on to that lead. It’ be nice to have a solid conservative represent our state in congress...The he can run for governor in 2010!

Tom said in a earlier email he could lose as many as 1400 votes in Nevada county but thought he would make it up in Placer and Eldorado counties

Why have those ballots not been counted in high tech America? Perhaps, it give time for the pagan demonRAT political machine to alter the results! GGGRRRR!!!

The slower the count, the more time for shenanigans. Even in the remote parts of California.
