Isn't this just the executive arm bowing gracefully to the inevitable? Already as a result of the June Supreme Court ruling on the case
Boumedienne et al v. Bush (PDF) docket number 061195, six Algerian-Bosnians detained at Guantanamo since October, 2001 have a habeas corpus hearing in progress in before a D.C. civilian court.
Dozens more are on the way (Boston Globe). It's a fait accompli. The detainees have prevailed in the courts on this issue.

Notice that taking care of the terrorists at Gitmo is a priority for Obama, just 6 days after the election. Bush is still president; he should ship them all to the mountains of Afghanistan for “safekeeping”.

No, he should send them back to where they came from and put out press releases in their country that they were very helpful in all information given and because of that, they were rewarded handsomely with hundreds of thousands of dollars. And because he worried that the next administration would not make good on that promise, he was releasing them now with the cash.
Those guys will be begging to stay at Gitmo.
