Souter is reviewing Berg’s birth certificate challenge to 0bama and has promised to have his decision before Nov. 4. Any guesses as to how he will call it?
In light of the recently released tape of Obama bemoaning that the Warren Court wasn't activist enough, and wishing that the court had implemented "economic justice," and the whole concept of "a living Constitution" - political speak for "the law is what I say it is - today" - should be enough to scare the pants off of anyone who envisions an America 10 years down the road with an Obama appointed Supreme Court majority.

Doug Kmiec is a Vichy Republican, one whom wishes to toady at the alter of Obamao, there is little reason to give him an ounce of credence as the Obamao does not share power.
