I think he needs to take it to the appeals court first. Third Circuit.He can request a writ of certiorari before judgment. That means the Supreme Court can agree to hear the case before the Third Circuit rules on it. This usually occurs in situations where time is of the essence and the Justices feel they would end up hearing the case anyway.
