Judge rejects Montco lawyer's bid to have Obama removed from ballot [Berg's lawsuit]

A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.

In a 34-page memorandum and opinion, the judge said Berg's allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.

Surrick ruled that Berg's attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."

It is unlikely that the courts will act before the election. BUT... they may act before the inauguration (which is likely the critical date). Then, Nancy Botoxi will have the privilege of or coronating a new president for the inauguration. Maybe she'll appoint herself! This could, but probably won't get very interesting.

It is interesting to see how some parts of the Constitution are taken seriously and some aren't. This document has always required a sense of cooperation among citizens. If that breaks down, the constitution will fail and we will be in deep doo doo.

Excellent post Stingray..I agree 100%! This is an outrage..one of a series we have been hit with in a row. We are watching our country be taken over and we can do nothing but sit by and watch it happen.

I think if the votes were counted fairly McCain would win, but we are up against the king of voter fraud...so logic says BO wins it. The left will do anything to get BO in office(the end justifies the means- the great tenant of marxism), once there he can do whatever he wants, do away with term limits...who knows?!

Libs are still convinced Bush stole the last two elections so they figure so what if they steal this one.

Nothing sticks to Obama...why should this lawsuit be any different?

"As a citizen of the United States and as a resident of the state of Florida I want to invoke my constitutional rights in demanding that all candidates for President and Vice President present proof of their eligibility for those offices as outlined in our Constitution, and that being proof of age and natural citizenship. I demand that these candidates furnish a copy of their birth certificates as filed in the various states in which they were born."

Those that wish to -- as citizens of their respective States -- may want to use it as a template.

I think he needs to take it to the appeals court first. Third Circuit.

He can request a writ of certiorari before judgment. That means the Supreme Court can agree to hear the case before the Third Circuit rules on it. This usually occurs in situations where time is of the essence and the Justices feel they would end up hearing the case anyway.

I live in Missouri. To renew my drivers license (lived in the same small town all my life, 54 years) I had to provide my birth certificate (not certificate of live birth) and my marriage license along with proof of insurance. This was just to legally drive. You’d think to become the President of the United States, a person should have to at least meet the first requirement.

Here’s another idea.

Since it will be impossible to get the mainstream media to report anything about this, let’s approach the international press. I am Dutch, and I’ve already sent emails to some Dutch newspapers. Hopefully they can research this issue and start publicizing it in the Netherlands. Also, we need folks to contact the British and Australian press. If anyone speaks French, German, Italian, Russian, get on the ball and start sending emails to these countries’ news outlets.

Let’s roll!
