Judge rejects Montco lawyer's bid to have Obama removed from ballot [Berg's lawsuit]

A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.

In a 34-page memorandum and opinion, the judge said Berg's allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.

Surrick ruled that Berg's attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."

And to all of you who feel this is a non-issue (I have personally received messages from people who feel I am just nonsensical to even talk about these things and have criticized me for posting information about this even)......

I believe this IS an issue we face as a country, if not now (but it IS relevant now) but in the future.

This situation has allowed us to discover there is a serious flaw in our system here. Whether you believe all of this or think it is an issue or NOT, having this information come out only to discover we have absolutely nothing we could do about it if true IS A SERIOUS PROBLEM FOR OUR COUNTRY AND WE NEED TO FIX SOMETHING HERE.

You may focus on the issues and vote, but we need to have SOMEONE figuring out what we need to do to get this vetting system figured out for our presidential and congressional candidates.

You may focus on the issues and vote, but we need to have SOMEONE figuring out what we need to do to get this vetting system figured out for our presidential and congressional candidates.

That is the overriding issue here, and goes beyond Obama. I called the office of the Secretary of State of California a few days ago and the guy I talked to flat out told me they do not verify the eligibility of any candidates - they assume the party handles that.

Wow, you are so right about that!

What you said about this clearing the way for illegal aliens or felons to run (so long as they have the backing of some political party) goes right with what I just said in post 161!

We have found something seriously missing in our vetting system. Even IF the Congress had any say if someone actually meets the qualifications or not (which I’m not even sure about that), would anyone think it would be anything but political (instead of constitutional) at that level?

Add to that that even most attorneys and politicians can not agree if even the CONGRESS has any say at all on this matter.

I just had a question pop up in my mind though... did this judge’s words set up legislation FOR the congress to take the matter of qualifying or not in the vetting process for executive and congressional candidates?

This is code for "Berg is absolutely right, but I don't want to apply the law." Federal Judges often use this language to simply ignore the constitution and the law.

IMO this is code for I want this taken to the SCOTUS.....Appeal is the only way of getting it there.

OTOH Wasn’t the judge suppose to release them on the 28th. In that case he’s given Berg the week end to prepare the appeal. Berg can file on Monday instead of next Friday.

Always suspected that Berg’s suit was a set-up designed to create a precedent in favor of Obama. It was clear to us in the legal profession that he was going to lose on the standing issue from the beginning.

WHich documents? The African birth certificates and affidavit from grandmother and step siblings were obtained in triplicate according to Hale. (Briought to the USA by “IMporters/Exporters” (Hmmmm CIA????)

DIdn’t Berg state on Savvage yesterday that the FBI and CIA have more information then he does. Like the local police they can not bring the charges, but can only testify in the case....

Can a member of Congress, who will be asked to assent to the results of the vote of the Electoral College on Jan 6th, 2008, issue subpoenas to obtain necessary documents to ascertain eligibility of the President-elect?

Yes on the issue of standing. No on the merits, but it may have some persuasive effect. It also has a political effect, as Dems can now crow that the case was thrown out when the topic gets brought up.
