Judge rejects Montco lawyer's bid to have Obama removed from ballot [Berg's lawsuit]

A federal judge in Philadelphia last night threw out a complaint by a Montgomery County lawyer who claimed that Democratic presidential candidate Barack Obama was not qualified to be president and that his name should be removed from the Nov. 4 ballot.

In a 34-page memorandum and opinion, the judge said Berg's allegations of harm were "too vague and too attenuated" to confer standing on him or any other voters.

Surrick ruled that Berg's attempts to use certain laws to gain standing to pursue his claim that Obama was not a natural-born citizen were "frivolous and not worthy of discussion."

There's nothing at all about this at America's Right.

Jeff has been following this closely, and even has a blog post specifically "reserved" for when the judge issued his ruling -- it was expected at the end of this week.

Other FReepers are pointing out that relevant websites have no notices/updates posted about this, and also the possibility that it is merely an unsigned order being pushed by Hussein’s CAIR lawyers...similar to how many overreacted when Berg posted on his website the yet-unsigned-by-the-judge order for expedited discovery or whatever it was, and assumed just because it existed (even though it was unsigned) meant that it was a bona-fide news item, etc.

“This is a question of who has standing to stand up for our Constitution,” Berg said. “If I don’t have standing, if you don’t have standing, if your neighbor doesn’t have standing to ask whether or not the likely next president of the United States—the most powerful man in the entire world—is eligible to be in that office in the first place, then who does?”

I don’t care if you think Obama is a natural born citizen, or if you think Berg is a nut because of his 09/11 theories, or that he is just a nut in general, he is absolutely correct in this statement.

This has gone beyond liking Obama’s policies. This has entered the territory of a group of Anti-Americans placing this man as President.

Berg did not think he would prevail at this level. As expected, the dismissal had nothing to do with evidence of Obama’s birth details, but everything to do with “standing” and judicial procedure.

The glaring, and ongoing question, which is the real concern at the forefront in anyone's mind who is concerned with our constitution, is whether Obama is actually eligible. I do not think this open, and very legitimate question is going to go unanswered for Obama.
