The Federal Election Commission has joined Barack Obama and the Democratic National Committee in asking a federal judge to dismiss a lawsuit filed by a Montgomery County attorney seeking Obama's ouster from the November ballot.
Philip Berg, who claims the Illinois senator was born in Kenya and can't run for president because he isn't a natural-born U.S. citizen, has no standing to make the claim, according to the FEC.
The motion, filed Tuesday in U.S. District Court in Philadelphia, echoes one filed last month by Obama and the DNC that states Berg hasn't demonstrated how he personally would suffer even if his ''ridiculous and patently false'' claims were true.

Show me in the constitution where it says no one can have EVER had dual citizenship as a child and qualify as President. (Dual citizenship vanishes when the child becomes an adult unless that adult actively avows that citizenship or has been living in that nation from childhood into adulthood.)
Dual citizenship is not a Constitutional bar to the Presidency. My son, for example, is a natural-born citizen of the US, but he is also a citizen, from birth, of two other countries. That is perfectly legal and would not prevent him from becoming President.

I would suggest you check the law as it stood in 1961, which would be the “ruling grade” as they say in railroading.
I would say yes. It happens in Senate races, where the candidate moves into the state just before taking office. Didn't Hillary do that?
But any Democrat should have a case against his running. Their candidate, say Hillary, will not get a chance to run for president within the party because an ineligible Obama won the primary. McCain might have a case because without Obama he'd have a weaker opponent in Hillary, thus Obama hurt his chances for the presidency.
The FEC simply does not want to deal with the fallout that may come from the COLB.
I think the highest levels of the Democrats party are trying to sneak Obama through and will fight to see him get elected no matter what it takes.

By the way, it's interesting that you are unable to discuss this issue without resorting to name calling and insults. Does this mean you know your position is on shaky ground, or do you just always lose control when someone disagrees with you?

I think too late - the Dems are on a collision course with history. Their masses want Obama.
The first three words of the Constitution give him legal standing:
We The People ...
If citizens have no standing to challenge the constitutionality of any specific issue, then the Constitution is no longer in effect.

People are free to do whatever they wish. But this isn't 'just checking'. This comes across as abusing the court system in an effort to stop Obama from getting elected. This will not get any traction in the courts.
I don't want Obama elected either, but it seems that it would be better to attack him on the issues instead of doing things that only make one look like a lunatic.
That is the law now AFAIK. The question is the law in 1961 when Obama was born, and it wasn't so definitive, as it had certain eligibility requirements such as period of residence within the US that the mother would not have met.
Might be too late. In any event, though, this case is all over but the shouting. Berg doesn’t have standing. This should be a slam dunk for the FEC. It’s frankly too bad that our tax dollars had to go to such a useless case as this.

The FEC doesn't handle elibility, they assume the Democrats vetted Obama. The thing that could snowball would be the realization that the Democratic party could be vetting a variety of candidates for other offices also that don't meet citizenship requirements.
