To be devil’s advocate...what if I just made up a SS number and put it on an application?? How can I be charged with ID theft without someone proving that I new the person that the number actually belonged if I made it up in my head? Under that scenario, if I filled in some web form and used a fake email address and it turned out to be a real address of someone else, I would be a criminal??? Not quite.

If you use any ssn other than your own you are breaking the law. Made up or not.

To start with it is illegal to make up SS numbers, it is considered fraud and is a felony. If you make one up and it happens to belong to someone else then the crime is compounded and you are guilty of ID theft whether you meant it or not, and you got the number by breaking the law to start with.

Using a fake Email address is not quite the same as using someones SS number, you can't charge items and open credit card accounts with a fake email address. One has to wonder though if you are filling out a form on the internet why a person would use a fake email, why not just ignore the form. The whole idea of filling out forms on the internet is usually to register for a site or request information. Kind of hard to get that info if you used a fake email.
