Jennifer Brunner belongs in the hoosegow.
The article: "David Myhal, a Republican from New Albany, filed a lawsuit...."
That is what it says about whom is bringing the suit.
Actually, it’s more like ‘every ACORN must be counted for a vote’.
THat is not what the Court said. The GOP has no standing to pursue this ONLY an individual Ohio citizen has that standing. The GOP should have known this and had individuals file the case not the party. There are no constitutional rights assigned to a political party in our election process.
The last thing the Founders wanted were political parties (they called them “factions” and considered them dangerous.)
But Jefferson’s hatred and fear of Hamilton caused him to form what became the Democrat party and the genii was out of the bottle.
An individual citizen of Ohio has standing or group of them.
The Party has no standing. An individual citizen does.
The Supreme Court just rulled that the Republican party does not the right to bring a case.. The supreme court ruled only a Citizen can bring a case and the state court was in error when it took the case brought by the Republican party.
What part of the supreme court ruling that only a citizen could legally bring suit escapes you?
Two questions about this;
First: If not the GOP what private entity would have standing would have authority to sue to force action, if not a private entity what public entity would or could sue?
Second: Why would the GOP go to the Federal courts with this in the first place? Election law is a state matter. If they were struck down in Federal court they could always go to the Feds with a denial of civil rights case claiming that the SoS was denying the citizens of Ohio their right to a free and fair election by permitting non-citizens to vote.
I gather that this new suit has been filed citing violations of State of Ohio election law, rather than Federal law.
Also, I'm not sure how the standing issue is resolved in this new suit.
Journalists are usually very bad at explaining legal issues in their stories; my only hope is that the GOP has found the right legal issue and the right venue to finally force Brunner to comply with the law.

Been lurking at HillaryClintonForum.net and read that GOP Senator Voinivich called Obama a socialist and a threat to the 10th amendment. Today.

Next time the GOP files a suit, they need to get a citizen—any citizen—to put his/her name on it, or these dismissals on a technicality will continue.
Brunner directly related to ACORN, Project Vote, hired Karyn Gillette...http://thurbersthoughts.blogspot.com/2008/10/acorn-worker-advised-secretary-of-state.html
