You are correct, but this could have been turned around to an advantage by just producing the certificate.
It would diminish all the arguments against Barry as just “sour grapes” Now he is fighting a suit in Federal court, which it looks like may go forth (since it hasn’t been dismissed out of hand.)
The local media in Toledo has picked up the story (Berg is a graduate of the University of Toledo Law School)And now he has another small fire in Washington.
Someone is going to have to file an answer to the suit. Seeing as how his attorney’s haven’t been able to convince a Federal Court to dismiss, I doubt a State Court would act on its own.
