The Saga of the Missing Birth Certificate carries on...the plot thickens

From Freeper philly ray:

Several things. It is alleged that Ed Hale, an avid Hillary supporter, has confirmed that he has in his possession a certified copy of a Kenyan birth certificate for Obama. This was reported by several posts I have read. Ed Hale's site and his radio station have been removed and it is stated that they were shut down for security reasons. Another posting I came across alleges that Phil Berg would neither confirm nor deny the report and that everything is being kept hushed for security reasons and that Phil Berg will not respond unitl he has had the opportunity to produce such in a hearing.

If the above is true, questions will swirl around the authenticity. I would presume it true, false birth documents will crop up as alleged proof Obama was born in Hawaii and alleged witnesses will be made avaialbe.

The law suit provides little by way of sound evidence except for the alleged dcoument from the Jakarta school. If that document is real, then other questions are raised as to whether Obama is a natural born citizen or a naturlaized citizen , the former making him elligible for Presidency, the latter would not. The arguments in the pleadings and in the last answer provided by Plaitiff Berg are very interesting in that they name a place for the birth. And, it is alleged the hospital name is known.

So there are actually two issues or avenue of attacks: 1. Obama was not born in the States and despite his mother being a citizen, she did not meet the rules for her child to be a citizen; and 2.) He lost natural born citizen status by virtue of the Indonesion citizenship, dual citizenship was not allowable due to the Hague convention rules and then there is no ability to become a natural born citizen thereafter, rather ownly a naturalized citizen.

Finally, Obama stated when applying for the Illinois bar that he never had any aliases. And he indicated publicly that he never was a muslim and never practiced such or studied such. If the Indonesion document is correct, then he lied on his bar application and he lied about his religion which would raise serious questions as to why. My gut is there is something here or Obama would have simply provided what was necessary. As an attorney, I cannot see any benefit from stonewalling, hiding behind legal maneuvering and why it is that he would not want to simply be transparent and end the controversy with the required documentation to prove thaht he meets the requirements to be President of the United States.

I’m not trying to rabble-rouse. I just anticipate the unrest when Obama gets jettisoned, and I’m glad there are plans to deal with it.

I agree, it is comforting to know safeguards are in place. It could be President Bush knows more than he is saying too. I dont think anyone wants to touch this issue without the needed proof.

That could very well explain the insanity of all this.

I think people overestimate the riot and violence reaction if Obama either gets arrested, gets removed because of non-citizenship, or loses.

There will be little action, except despondency. Perhaps some blacks will learn, but there will be almost no general riots. Nothing like the late 60's.

The reaction, I think, will be a deflation, not a conflagration.

Any thoughts on what the dems would do in that scenario? Draft Hillary maybe? They’d have to have someone to run I would think. Man it’s too much to hope for.

I haven’t heard this take on obama. If it is proven that his parents marriage was illegal ue to polygamy then....

Does polygamy secure Obama’s citizenship?
By Steve Miller Monday, August 11, 2008

The Saturday, Aug. 9, Canada Free Press front page story I authored generated a firestorm of letters to the Toronto newspaper.

One particular Letter to the Editor makes some vital points, and asks an important question not before asked: Does polygamy protect Barack Obama’s status as a natural born US citizen?

According to the writer, “Obama Is a Natural Born US citizen, regardless of place of birth, because his parent’s marriage was invalid. The problem comes down to the validity of Obama’s parent’s marriage. When he was 18, Barack Obama Sr. married a woman named Kezia and had four children with her. Two of them later returned to Kenya from the United States. He never divorced her. In the US, polygamy is illegal. If you are already married, regardless of where you got married, all subsequent marriages are invalid. This is the case with the marriage of Stanley Ann Dunham and Barack Obama Sr. in February 1961. Barak Obama Jr. was born out of wedlock. As a child born out of wedlock, a different citizenship law is applied.”

The writer went on to explain: “The U.S. citizen parent, and the foreign parent must be married. The actual law pertaining to this issue can be found here .”

The writer then provided this US law:

7 FAM 1133.4-3 Birth Out of Wedlock to American Mother (TL:CON-68; 04-01-1998) a. Section 309 (c) INA: A child born abroad out of wedlock after December 24, 1952, to a U.S. citizen mother acquires U.S. citizenship if the mother was physically present continuously for 1 year in the United States or its outlying possessions at any time prior to the child’s birth.

If the writer is correct, the above law may supercede the law that was in effect at the time of Barak Obama’s birth in 1961 to an 18 year old mother (below), and he is legally qualified to hold the office of President.

Here is the law per FindLaw.com that applied at the time of his birth—if his parents were legally married:

4. December 24, 1952 to November 13, 1986: If only one parent was a U.S. citizen at the time of your birth, that parent must have resided in the United States for at least ten years, at least five of which had to be after the age of 16. If the above law is found to be the correct law applying at the time of the birth of Barak Obama, he is legally not qualified to hold the office of President.

Which of the two laws applied at the time of his birth?

If his parents were not married at the time of his birth, then Barak is qualified under then-current law to hold the office of President.

If his parents were married at the time of his birth, then Barak is not quantified under then-current law to hold the office of President. Also, according to all research so far tendered, the law at the time of his birth is the only law that applies in this case.

Citizenship laws enacted after November 13, 1986 are much more liberal, and have spurred the coining of the title “anchor baby.” However, it is not believed that newer laws supercede the much stronger citizenship law in effect at the time of Senator Obama’s birth, and his ability to be a natural born citizen of the United States, nor does it matter that he was born in Hawaii that gained statehood in 1959.

This important matter has caused much discussion and confusion. It deserves a more complete investigation. American voters deserve a thorough explanation and clarification before election day.

Am I missing something? Even if Obama was born in Kenya wasn’t he born to a citizen of the US, and wouldn’t he then automatically have the option to have dual citizenship?
A "natural born citizen" is, I think it logical to believe, a person who was a citizen at the time of his birth. That means that he would have to have been a citizen according to the laws of the United States at the time that he was born, not according to laws the United States may have passed later.

At the time Obama was born (at least according to putatively knowledgeable FReepers), he would have inherited US citizenship from his American mother even if born in (in this instance) Kenya if she had lived continuously in the US for 5 years after having attained the age of 14. I.e., he could have inherited American citizenship from her if she had been nineteen - but she was only 18 when he was born. Hence, if he was born in Kenya as alleged he was not an American citizen at the time of his birth.

Certainly that is a ticky tacky kind of distinction upon which to declare someone ineligible for the office of POTUS - but no more so than having been raised outside the US for his first ten years, approximately, and adopted by an Indonesian stepfather and having (it is alleged) had an Indonesian passport - and yet being declared eligible as a "natural born citizen."

But ask the people Obama has gotten past in his climb up the ladder, and they will tell you that Senator Obama knows all about ticky tacky. Getting opponents thrown off the ballot is just his style, which explains why he has gotten where he is without ever having faced serious opposition (other than Hillary). And he apparently played hardball in the caucus states in order to achieve that.

You would think that the US Courts would get this over with before the elections. What’s the hold up?

Motions by the DNC and Obama's lawyers.

One would think that it would be a lot faster and easier to produce verifiable, documentary evidence as to the location of Obama's birth. Doing so would conclusively end the lawsuit and establish, beyond question, Obama's qualification to be president. (That presumes that they can, of course.)

I think if he loses, other than by some proven thing like not a citizen etc, there will be blood- and burning and looting. The black expectation is so high.
Some prominent figures have already said they’re set to ‘march’ if he loses.

It doesn't matter if he's legally eligible to be there.

Does to alot of folks, folks who took these oaths, for example

I, (NAME), do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.

, [name], do solemnly swear, that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.

If he’s sworn in we’ll never get him impeached and convicted.

Although it's obviously uncharted territory, I don't see why he'd need to be impeached. The House, which certifies Presidential elections, would just have to declare him ineligible, and Biden would be President. Of course good luck getting that done with a 'Rat majority in Congress.

No, if that happens, and people are convinced of it, it will have become time. Right Claire?

Oh, it matters to me. I'm just saying that it doesn't matter to his supporters or the people who could rule him ineligible. He will be running, eligible or not, right through November. Sad that his campaign has turned our country into third world country. His campaign has even blunted the horrible accusation of racism. The word has no meaning lately just like when OJ was acquitted.

Since you’ve never run a small business, I’ll assume that you don’t know that before you can work, you have to provide documentation so the employer knows you are eligible to work. It’s what EVERY single citizen has to do if they want a paycheck.

Obami has not even had a private sector job since that law was implemented.

I was sort of caught unawares myself. I'd worked for the same outfit, through a change of ownership, barely. But shortly after that change, I was laid off. I actually didn't know I needed my paper SS card (which doesn't even have a picture on it), so I reported to my new employer without it. Had to run down to the SS office and get a temporary certificate, and then take the permanent one in when I got it.

Come to think of it, I'm not sure where that replacement is either. You'd think my Reserve military ID, which has the SSN on it would be good enough...but Noooo.

Well, the Federal Election Commission has the problem that people have been and are voting for Obama in the general already.

Actually they've let them vote for electors, nominally pledged to Obama and Biden. The electors can just as well vote for whatever replacement the DNC might come up with. Biden is a candidate for VP, so it need not be him. How does Clinton-Biden sound?

Not trying to be contrary, but why would anybody have to put up funds for Corsi to get out of Kenya? He wasn’t charged with anything.

If this is all true, I would think he wasn't charged with anything *because* someone put up funds. It is a Muslim country after all, despite it's British colonial heritage.

This is a mess--but imho it is going nowhere. The Dems are famous for hiring reams of high-paid lawyers who can make a blue sky look red to juries with 20-20 eyesight. Combine that with courts that use "contemporary standards" and "world opinion" as criteria for decisions and video of a Kenyan childbirth will not keep the guy out of the White House.

:-(
