Yes, if he assume the office of the presidency, but that is NOT the case here IF he is deemed a total fraud of eligible to assume the position. Biden is NOT qualified either???

Why wouldn't Biden be qualified?

The 20th Amendment deals with the death of a president-elect before inauguration. According to that the vice-president-elect becomes president. If somehow Obama is found to be ineligible to be sworn in as president then I'm sure it would wind up in the courts. I believe that the court rule that Biden would be president, just as if Obama had died.
