That would be up to the Democratic National Committee to decide.

Most likely Biden would become the Presidential candidate or ? they might have to have a mini convention and name someone as President candidate... but,, it would not look good on the Democrats part.
They can't blame this on the Republicans.... it's a Democrat ( Burg ) who is filing this in court.
