In the lawsuit, Sharratt claims the comments Murtha made in 2006 about the Haditha killings also violated the Marine's constitutional rights to due process and presumption of innocence.

Murtha was in no position violate his constitutional rights to due process. The defamation claim is pretty much all he has. He might have a malicious prosecution claim against the NCIS agents. I'm surprised they are not also being sued, but maybe that case will be filed later.

Don’t members of congress have some exemption of long standing from suits related to what they say while on the job ?
