Most lawyers should know that, and ex specially in this kind of case of magnitude he should know he better make sure he has the evidence.

Probably for the same reason he filed the 9/11 suits. Publicity. Have you read any of his filings? They seem tailor made to get thrown out of court after the headlines of the filings have passed. Have you read his Motion for Expedited Discovery? What kind of attorney is so inept as to require discovery to be completed by a non-existent date - September 31, 2008? All his stuff seems to have little nuggets in them to ensure that they will be thrown out, and so he won't actually have to prove anything.
