EL PASO, Texas Two former Border Patrol agents convicted of shooting a drug smuggler and trying to cover it up have been denied a request for a new hearing.
The 5th U.S. Circuit Court of Appeals in New Orleans denied the request by Ignacio Ramos and Jose Alonso Compean on Wednesday. The same court upheld the men's convictions in July.
No reason was given for the Wednesday's denial.
Ramos and Compean are each serving sentences of more than 10 years for shooting Osvaldo Aldrete Davila in the buttocks while he was fleeing from an abandoned marijuana load in 2005.
Aldrete was sentenced to 9 1/2 years in prison for his role in two seperate smuggling efforts later that same year.

Ya know I just bought a gun. According to the Federal Form 4473, being an illegal alien disqualifies one from purchasing or owning a firearm within the US. So, you might understand why it is that I’m skeptical of your assertion that illegal aliens have the contitutional right to keep and bear arms.

Ramos and Compean, being convicted felons, can no longer vote or own firearms. Are they now illegal aliens also?

There's a lot of that going around in the Border Patrol, apparently. Say, when you got your badge, did you swear to uphold the law or anything like that? Or are you (constitutionally) entitled to make it up as you go along if the subject is an illegal alien?
Actrually there is a lot of incompetence in the Border Patrol, meted out by people just like you. I bet you didn’t kow that, you know, that we have people like you who sympathize with criminals.

I thought Gary Weiser was just a hack lawyer that Juarez stumbled across in the phone book. If you remember he was the lawyer present in September when Juarez changed his story for the umpteenth time and suddenly remembered seeing Compean.

Given that Gary Weiser represented Victor Bieganowski in this case, I dont think that it could have occurred here. Gary Weiser was formerly an El Paso Assistant District Attorney and also represented one of the Border Patrol agents who turned on Ramos and Compean, Juarez.
And this is what happened in Sept when Weiser was present with Juarez.

FYI—suebob and I discovered the Weiser/Kanof connection after a newbie post back in March 2007
The post referenced the Bieganowski case and gave the website www.doctorbfiles.com. After going to that website and sifting through some of the PDF files, I found Weiser’s name — and recognized it as the same name that Oscar Juarez mentioned in his testimony.
