EL PASO, Texas — Two former Border Patrol agents convicted of shooting a drug smuggler and trying to cover it up have been denied a request for a new hearing.
The 5th U.S. Circuit Court of Appeals in New Orleans denied the request by Ignacio Ramos and Jose Alonso Compean on Wednesday. The same court upheld the men's convictions in July.
No reason was given for the Wednesday's denial.
Ramos and Compean are each serving sentences of more than 10 years for shooting Osvaldo Aldrete Davila in the buttocks while he was fleeing from an abandoned marijuana load in 2005.
Aldrete was sentenced to 9 1/2 years in prison for his role in two seperate smuggling efforts later that same year.

Hitting someone or spraying them when not authorized would constitute assault. In fact Compean would have been performing assault by merely swinging and missing with the shotgun had he done so without cause. He was not charged with that.

As far as I can tell, you choose what you decide to remember and what you decide to forget. In this case, you're hoping that I'll make some sort of an error that you can then pounce upon. It's a peculiar way to debate people.

With all the charges already in front of R&C, that would have been a ten yerd penalty assessed against the prosecution for “piling on”.

Agreed. I’m proud of that moment as well as many others even more important.
What I don’t understand is the dismissiveness of these efforts from this new cadre of people on Free Republic. They don’t respect their go-before-ers, they show no respect for the “patron”.
