EL PASO, Texas — Two former Border Patrol agents convicted of shooting a drug smuggler and trying to cover it up have been denied a request for a new hearing.

The 5th U.S. Circuit Court of Appeals in New Orleans denied the request by Ignacio Ramos and Jose Alonso Compean on Wednesday. The same court upheld the men's convictions in July.

No reason was given for the Wednesday's denial.

Ramos and Compean are each serving sentences of more than 10 years for shooting Osvaldo Aldrete Davila in the buttocks while he was fleeing from an abandoned marijuana load in 2005.

Aldrete was sentenced to 9 1/2 years in prison for his role in two seperate smuggling efforts later that same year.

That’s what is funny. I’m poking you in the eye and you think it’s evidence that I’m a lunatic. (Bearing in mind that I asked you to provide other evidence that I’m a lunatic and you have as yet declined).

If he always had carried a gun, why didn’t he have one the second time he got popped for smuggling?

Things slow in the western suburbs? Is that why you’re here? Aren’t you under water?

He was arrested again for smuggling, but not for carrying a weapon.

I don't think he was arrested at the scene. I believe it was an informant(if this is the October 2005 event).

Yadda, yadda ,yadda... I know your Black Knight "It's only a flesh wound." routine.

"Weren't you asking me about corroborating evidence earlier? If you've read the transcript, you already know what it is."

I have read what I consider to be key sections of the transcripts. I am simply deferring to your understanding of the same. Your interpretation of that information is entirely your own.

Right. So I will remind you again . . . if I am a lunatic, you should have no trouble proving it . . . .

No reason to resort to tired Monty Python references.

I haven't read any information one way or the other, have you?

Because frankly, now that I think about it, your contention that I am a lunatic revolves around my opinion that Compean is a fat-ass that doesn’t know how to shoot.

I have read what I consider to be key sections of the transcripts.

Well here is a key point. This is where Davila testified he raised his hands.

25 Q. I think -- you're right. I think you said that there were
David A. Perez, CSR, RPR
Aldrete-Davila - Cross by Ms. Stillinger 189
1 two or three agents behind you, to the north?
2 A. Yes. When I was on the other side of the water, I turned
3 around, and I saw two or three agents.
4 Q. Okay. And those two or three agents, or somebody to the
5 north of you, was also yelling something at you, weren't they?
6 A. Obscenities.
7 Q. Okay. They weren't telling you to stop?
8 A. No.
9 Q. Okay. You understood they wanted you to stop, though,
10 didn't you?
11 A. Well, it's a very different way of getting across, so one
12 can understand it.
13 Q. Okay. Let me ask you the question again.
14 You understand they wanted you stop, didn't you?
15 A. Yes, and I stopped.
16 Q. Okay. Well, I understood that you kept walking with your
17 hands up, didn't you?
18 A. When I stopped, when they yelled at me to stop, I stopped,
19 and I raised my hands, and I remained stopped. And that's when
20 I saw the agent -- and that's when I saw the agent in front.
21 And then I walked up towards the agent with my hands
22 up, and that's when he came closer with the rifle. That was
23 the lapse of time that I walked with my hands up.
24 Q. Okay. So you stopped first, and then you decided to keep
25 walking. Is that right?
David A. Perez, CSR, RPR
Aldrete-Davila - Cross by Ms. Stillinger 190
1 A. I stopped, and then I took one step.
2 Q. Okay. Well -- and didn't you say that you -- that you
3 decided, since the agent was here (indicating), you decided you
4 were going to try to get around him to the left?
5 A. When I decided to avoid him by going left, they hadn't
6 started yelling yet.
7 When I went that way (indicating), that's when the
8 agent got closer to me. And he was about a step away, and
9 that's when I raised my hands.

One step away!!

I did not call you a lunatic but you are trying hard to get there.

So now you are not calling me a lunatic. I LOVE this game, what is it, Heidegger? I never was into this postmodern stuff.

You are not much into the English language either. You seem rather intent on earning the "Lunatic" merit badge. Will it match your first place "Inanity" ribbon? Or are you just trying for an oak leaf cluster to the ribbon?

He was arrested after being identified as the person who dropped off a 750 load. I stand corrected. I just knew he hadn't been charged or convicted of a firearm offense and assumed he had actually been stopped with this second load.

That was a “750 _pound_ load.” I can’t think tonight. I’m off to bed.

At this stage, I have to assume (sorry that it got your panties in a wad earlier) that our individual dialectics are completely incompatible. I never came to grips with your reflexive theory that my version of truth oppresses yours (thats more of a Foucault-thing), but what can I say? I'm just a cityboy who has come across an internet cowboy who thinks he can selectively edit (and choose) his responses. All in order to favor his argument.

You are brilliant. There are professors (in Women's Studies, and elsewhere) who admire you. Keep it up.

So you mingle with Women's Studies professors, how interesting, but let's get back to the game. This is better than the Bash a Gopher. Pop up three more times and I can earn the gold award.
