Border Agents Who Shot Smuggler Denied Appeal (Ramos & Compean)

EL PASO, Texas — Two former Border Patrol agents convicted of shooting a drug smuggler and trying to cover it up have been denied a request for a new hearing.

The 5th U.S. Circuit Court of Appeals in New Orleans denied the request by Ignacio Ramos and Jose Alonso Compean on Wednesday. The same court upheld the men's convictions in July.

No reason was given for the Wednesday's denial.

Ramos and Compean are each serving sentences of more than 10 years for shooting Osvaldo Aldrete Davila in the buttocks while he was fleeing from an abandoned marijuana load in 2005.

Aldrete was sentenced to 9 1/2 years in prison for his role in two seperate smuggling efforts later that same year.

No, I happen to think that, if they shot at an unarmed fleeing man, the deserved to have some punishment.

I’m not a fan of mandatory prison terms though, and think that given the circumstances they could have served less time.

But I don’t want leniency for police officers who shoot people — I want to treat them more harshly, because they are given the responsibility to keep the peace, and there is nothing as dangerous as a rogue cop.

I think the Palin “TaserGate” incident demonstrates why it is important that when police officers break the law, they need to be punished as harshly or moreso than a common criminal.

I don’t personally know that these men were guilty. My opinion is that they both are guilty of a coverup of a crime that, if they had not covered it up, probably would have been swept under the rug. I think Ramos actually could justify his actions, except for the coverup. I think Ramos could have gotten off light because he didn’t HIT the guy.

But the coverup linked them together in the shooting, and a jury of 12 people felt they were guilty. Multiple judges who have earned respect see no error in the jury decision, or the actions of the prosecuter and judge.

I trust that those directly involved had a better understanding of the situation than I do looking over transcripts.

I would have been happy if there was an “overturn”. It would have meant there was something wrong with the trial. But it didn’t happen.

From what I understand, the appeals court ruled that way because they decided the BP investigation wasn't an “official proceeding”, not because Ramos and Compean did not fail to report, tamper with or destroy evidence.

In other words, a technicality.

But thanks for trying to misrepresent that fact. You get more desperate as time goes by.

He probably said that because dirty cops make ALL good cops look bad and bring dishonor on their departments and agencies. I will say this though, I don’t think Ramos or Compean were dirty cops, just bad ones.

And here on FR we have people assiduously defending/excusing what they did because the fleeing suspect looked Mexican and spoke spanish. Forget about him being a drug mule or an illegal...they didn’t know that at the time of the shoot.

All they knew was the van took them on a short high speed chase and they guy looked/spoke spanish. And you know how rare it is to find a mexican looking/spanish speaking person in a border town. No real Americans meet that description (/sarcasm).

I support this statement. The testimony clearly demonstratesd that at no time did Ramos or Compean act in a fashion that was reasonable or consistent with an LEO who belived they were in fear for their safety, much less the safety of their fellow agents. This is why their contention about seeing a gun in the hands of OAD was not believed by the jury or about 98% of the people who have read the transcripts.

It is the reason why the jury convicted, it is one of the main reasons for my 180 on my opinions of this incident and about R&C, and I’m going to assume the same for others who have investigated and researched the facts as I have.

Bull! Ramos did not pick up anything. He merely did not overtly report the shooting. This is what the ruling stated.

The defendants were charged with tampering with an official proceeding under 18 U.S.C. § 1512(c) by failing to report the shooting to their supervisors. They argue on a number of grounds that such a failure to act constitutes neither tampering with evidence nor inhibiting an official proceeding, an argument that we conclude has merit.

Failing to report shooting a weapon is not a crime.

You get more desperate as time goes by.

And you continue to lose arguments and fall back on Ad Hominems.

After reading the transcripts, it is my opinion that Ramos and particularly Compean at no time ever believed their lives much less their safety nor that of their fellow agents, was ever in danger.

Did either of them ever yell out “GUN” to warn their fellow agents of potential life threatening danger, agents who they believed were crossing the ditch to come to their aid? NO.

When Compean rises after emptying his magazine at the fleeing OAD, did he ever once take any kind of cover that might help protect him from the gun wielding OAD, particularly since OAD might be hidden in the “very dangerous” vega where there is much brush for a gunman to hide in” NO.

In fact Compean casually rises, casually walks, fully upright, over to Ramos, then casually walks back to the levee, where he and Ramos casually walk UP to the top of the levee where they were elevated like a cherry on top a white cake, fully upright, while a rogue, hidden gunman could be hiding virtually anywhere and take a couple pot shots at them? NO.

Doesn't Ramos, who he says believed his partner might be shot, run over fully upright and takes his one famous shot at OAD, then remains fully upright while they look for him, then pats down Compean...still fully upright, then casually walks back to the levee, up it's side and then on top where he would make a perfect target for a disgruntled gunman he just shot?

Do either Ramos or Compean, at any time or in any context, tell any other agent or supervisor that the perp, OAD, had a gun and pointed it at them? NO.

I could continue but it feels like piling on.

So in your mind Aldrete-Davilla was unarmed when he was shot. And we know this solely upon Aldrete-Davilla’s testimony.

Or do you have some other explanation of how you know that he didn’t have a gun, as Ramos and Compean claimed?

An equally plausible conclusion, using your ‘logic’, is that if Ramos and Compean were “white, American-born citizens” then you would be defending them instead of insisting that they be imprisoned.

Funny how it is that you focus primarily on race. But then you couldn’t keep your own motivation to yourself.

The primary witness against Ramos and Compean is now in prison.

It’s truly unfortunate that his career of crime started after he was unjustly shot while trying to surrender to Ramos and Compean, when he was caught making his first and only drug run, in the attempt to raise money for his cancer-stricken mother.

Sutton’s description of his truth-telling witness is a thing of beauty to look back on. Maybe you can drop Aldrete-Davilla a line and tell him you still think highly of him, and that you believe he was unarmed and innocent.

That screed reads like the open-borders extremism of Paul Gigot at the Wall St Journal. Border control is “stupid and counterproductive”, “rewarding sloth and punishing industry”. The usual economic benefit justifies all argument that comes from non-patriots whose only loyalty is to their own wealth.

There wasn't a cover up. From what I've read, they weren't even aware they hit him. It was only months later that Davilla, with his ass in a legal sling and the medical bills on his heels, decided to squeal like a stuck pig.

Smells like yesterday's garbage from the get go. Anything to paint the BP as a bunch of thugs, and harmless drug smuggling, border invading, criminals as victims.
