Does anyone know if the Demagogues (legally) CAN change candidates now? I know we joke about them “pulling a Toricelli” with either Obama or Biden, but what are the legal aspects of that once a candidate has been nominated by the convention? Can the party really substitute a different candidate without calling another convention?
Dunno for sure, but I think the candidate would have to be willing, comatose, or dead.
“Legally”????
Democrats don’t b’lieve in no stinkin’ laws! They will make something up just like they did with Torricelli.
We witnessed almost the same thing in Maryland, when a competitor in the Dem primary for governor suddenly discovered that he was suffering a severe depression that would interfere with his being able to do the job of governor. In fact, his opponent was more politically connected than he was, and it was the other man’s “turn.”
Just as suddenly, he had a total recovery, after the election and the guy that won appointed his previous opponent to a $Quarter-million a year job at the University of Maryland.
“Can the party really substitute a different candidate without calling another convention?”
nothing in the Constitution about parties OR conventions.
It’s a state-by-state issue, since there is no national election.
Some states may have laws that allow a swith, but if a state has a filing deadline that has passed, DNC would need to go to that state’s courts.
Mondale was locked in, he knew he was toast long before chad time. Dukakis, too. Kerry and Gore were sure they’d win, so the issue never came up.
As far as this election, the hen must sit a while before we enumerate the progeny.
